Auckland Business Sales Privacy Policy

We take our privacy responsibilities very seriously. This privacy policy explains how we collect, store, use, disclose, process and protect your personal information. We are committed to complying with the Privacy Act 2020 and to good practice standards.

“Agreement” means an agency agreement or any other agreement that you have entered into with us.

“Auckland Business Sales”, “we”, “us” and “our” refers to the Auckland Business Sales entity with which you have entered into an Agreement, which has provided you with services (Services), or to whom you have otherwise provided your personal information, including:

a. Auckland Business Sales Limited, or a subsidiary or related company; or
b. any authorised representative, contractor, or agent acting on behalf of Auckland Business Sales.

“personal information” means information about an identifiable individual, as defined in the Privacy Act.

“Privacy Act” means the Privacy Act 2020 and includes regulations and other instruments under it, including any amendments or replacements.

“You”, “Your” includes any authorised representative acting on your behalf (such as a solicitor, trustee, or director), or where you are the authorised representative, the individual you represent. If you provide us with personal information about another person, you confirm that you have collected that information in accordance with the Privacy Act and are authorised to disclose it to us.

Application of this policy

This privacy policy applies to any collection of your personal information by us and should be read together with the terms of any Agreement. In the event of any conflict, the Agreement takes precedence.

By providing us with your personal information or entering into an Agreement with us, you consent to the collection, storage, use, disclosure, and processing of your personal information in accordance with this policy.

We may update this privacy policy from time to time to reflect changes in legal or business requirements.

Why we collect your personal information

We may collect personal information about you and your representatives for the following purposes:

  • Facilitating the sale and purchase of businesses and commercial assets, including recording enquiries, managing buyer interest, preparing documentation, and supporting transactions
  • Marketing and promoting current and future business opportunities, including advertising, direct marketing, and maintaining ongoing client relationships
  • Conducting market research and surveys
  • Analysing website and sales data
  • Managing internal operations, staff training, and improving services
  • Complying with legal obligations, including under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 and other applicable laws
